Terms of usage

These terms cover how Motifiti works and what you agree to when you use it. They apply whether you are buying, selling, or just looking.

We have written them in plain language on purpose. Where something is not offered, they say so rather than leaving you to assume it is.

What Motifiti is

Motifiti is an online marketplace that connects people buying cars with people selling them. We are not a dealership, we do not own any of the vehicles listed, and we have no yard or showroom.
Every car on this site belongs to the seller who listed it. Viewings, test drives, inspections, negotiations and the sale itself happen between you and them.
We are not a party to your sale and we are not your agent.

Motifiti never holds the money for a vehicle. There is no escrow on this platform, and we take no commission or percentage of any sale. Whatever a buyer pays for a car goes to the seller.
Treat any request to pay Motifiti for a car as a warning sign, and tell us about it.
Buyers pay nothing to browse, search, save cars or message sellers.
Sellers pay to list. What a listing costs and how it is paid is shown when you list, and we will tell you before anything changes.

You may only list a vehicle you own or have written authority to sell.
Your listing must describe the actual vehicle: real photographs of that car, an honest description, and a price you are willing to sell at.
You must hold the paperwork you would need to complete a sale, and you must disclose anything attaching to the vehicle, such as a loan, a lien or outstanding fines.
You are responsible for what you write and upload, and for answering buyers honestly.

Satisfy yourself about the vehicle before you pay anything. Inspect it, or have somebody inspect it for you, and confirm the ownership and the paperwork independently.
Motifiti does not inspect, verify or value the vehicles listed here, and nothing on this site is a recommendation to buy.
Meet in a public place, and never send money for a car you have not seen.

Listing anything that is not a vehicle, or using a listing to advertise something else.
Photographs that are not of the vehicle being sold, including screenshots taken from other sites.
Sexual, violent, hateful or otherwise offensive content anywhere on the platform.
Pretending to be somebody else, or listing on behalf of somebody without their authority.
Scraping, bulk copying or republishing listings, or using the platform to harass anybody.

Some listings are checked before they become visible to buyers. This is routine, it is usually quick, and being checked does not mean anything is wrong.
We may hold, edit or remove a listing, and may suspend or close an account, where these terms are broken or where we have good reason to believe somebody is being harmed.
If we remove something of yours, you can ask us why.

Messages between buyers and sellers are sent through this platform and are stored here, so they can be read by the people in the conversation and, where there is a complaint or an investigation, by us.
Say nothing in a message you would not want produced later.

Motifiti provides document templates, including sale agreements, as a convenience for sellers. They are a starting point, not legal advice, and we are not your advocate.
You are responsible for reading a document before you issue it, for changing it to match what you have actually agreed, and for whatever you sign.
Some of them carry real consequences. An agreement selling a vehicle by instalments is one, and recovering a vehicle is a legal process rather than something a seller may do alone. Take your own advice before you use that one.

Your photographs and your words stay yours. By putting them on Motifiti you allow us to display, store and share them as part of running the platform, including in search results and link previews.
Only upload what is yours to upload.

We collect and use personal information to run the platform, in line with the Data Protection Act, 2019. We do not sell it.
Other users see what you choose to show them: a listing shows what you put in it, and a conversation shows your messages.
You can ask us what we hold about you, and ask us to correct or delete it.

That the platform is available without interruption, or free of faults.
That any listing is accurate, that any vehicle is as described, or that any person is who they say they are.
That a listing will sell, or reach any particular number of people.
We are responsible for running this platform honestly and carefully. We are not responsible for a deal that goes wrong between two people who met here, and nothing here limits any right you have under Kenyan law that cannot be limited.

We may change these terms. The date at the top says when they last changed, and where a change matters we will say so on the site.
These terms are governed by the laws of Kenya, and the courts of Kenya deal with any dispute arising from them.
